A Federal court has handed another big win to Athena Cosmetics, Inc. (parent company to RevitaLash® Cosmetics) in its battle against counterfeit product sellers AMN Distribution, Inc. and Moishe Newman.This case brings attention to the defendants’ website called BrushExpress as well as numerous stores on eBay and other online marketplaces they operate under various aliases. In a previous ruling, the Federal court determined that the defendants engaged in trademark infringement involving the use of counterfeiting, and breached a settlement agreement that was signed when Athena first caught them selling counterfeit products.In this latest ruling, the court ordered the defendants to pay over $1.1 million in damages to Athena Cosmetics.
